Company Investigations

In order to stay competitive, companies need to monitor their employees and take disciplinary action if any suspicions are brought to light. Employees who regularly phone in claiming sickness or other reasons for not attending work may have aroused suspicion but companies have no proof to confront them with.  
JonIT Services would accurately report on the evidence gathered during the investigation to either expose persistent false claims 
or provide information to support employees genuine claims.
Schools and colleges today are working within tight budget constraints.  The desired productivity of the workforce is sometimes put under strain if one or more members of staff are failing to attend work regularly or are on long term sickness.  Unfortunately, it is difficult for any organisation to gather sufficient concrete evidence to present a case for misconduct.  This is where the services of a special investigation team can be invaluable.
Types of investigations

Suspicious sickness / time off by employees
If an employee has been signed off long term sick, but an envious friend has let it slip that they are fine and enjoying the break from work at the companies expense, then evidence is required for an official reprimand, warning, or if this is a regular occurrence a possible dismissal.
We would compile a report with evidence to clarify the situation.

Moonlighting
An employee may be working well for you during the day but they also have another job at night or at the weekend.  This may be fine but you may have a company policy that employees must not have a second job or that other employment must be declared.  What if it was work for your competitor down the road? What if the night work was affecting their day time work performance?

Company secrets
Your company operates in a sensitive market with only a handful of other companies in the country fighting for contracts.  You are ahead of the opposition because you have invested heavily in Research & Development and the new designs are winning your company orders.  But recently your company has noticed features of the designs appearing in the oppositions products.  Is this purely coincidental or has there been a leak of company secrets from inside your works?  You need to find out and we would endeavour, with assistance from your company, to audit the trail the sensitive information has taken.

The Law
In relation to surveillance, there is a legal and enforcement section of the Human Rights Act 1998 (HRA) so called the Regulation of Investigatory Powers Act 2000 (RIPA).  In simplified terms, this means that any 'Public Body' has to be accountable for carrying out surveillance in order to prevent a persons human rights being violated.
The term 'Public Body' includes:
Police, Customs & Excise, Inland Revenue, Department for Work & Pensions (including Social Services), Trading Standards, Environmental Agency and Local Authority.
Directed, covert surveillance carried out on behalf of a 'Public Body' will require the relevant authority to sign RIPA forms prior to the start of the investigation.
The Criminal Procedure and Investigation Act 1996 (CPIA) states that surveillance may be carried out in any public place so long as trespass is not committed.  There are also set guidelines that apply to surveillance carried out in public places that apply in particular to a 'Public Body'.  All evidence that is obtained must be revealed as it will be required to be disclosed to the 'other side'.  However surveillance methods, tactics and the location of the observation posts do not have to be disclosed.
